PLEASE READ THESE TERMS AND CONDITIONS OF PURCHASE CAREFULLY. SECTION 13 INCLUDES AN ARBITRATION PROVISION REQUIRING INDIVIDUAL FINAL ARBITRATION OF DISPUTES INSTEAD OF JURY TRIALS AND YOU WILL NOT BE PERMITTED TO PURSUE DISPUTES OR CLAIMS AS A CLASS MEMBER IN A CLASS ACTION OR SIMILAR PROCEEDING.

INTRODUCTION
VALUE Home Appliances (“VALUE” or “We”) welcomes you, the end-user (“User(s)” or “You”) to our online places of business, the VALUE website, www.value-appliance.com, (“Website”). The Website is the property of VALUE.

This agreement (“Terms of Purchase”) sets forth information necessary for Users to browse and pay for products and services (collectively, “Product”) on the Website.

These Terms of Purchase apply to any purchase of Product on the Website. BY CLICKING ANY “BUY” OR “ORDER” BUTTON OR OTHERWISE INITIATING AN ORDER THROUGH THE WEBSITE, YOU ACKNOWLEDGE AND AGREE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY THE TERMS OF PURCHASE. IF YOU DO NOT AGREE TO THESE TERMS OF PURCHASE, DO NOT USE THE WEBSITE TO MAKE ANY PURCHASE(S).

VALUE’s Terms of Use applies to the Website and is made a part of these Terms of Purchase. Matters not set forth herein shall be determined by the Terms of Use. In the event of any conflict between the Terms of Purchase and the Terms of Use, the Terms of Purchase will prevail. Please note that VALUE’s Privacy Policy applies to Your use of the Website and information You provide while making a purchase. Please read the Terms of Use and Privacy Policy carefully.

AGE
You must be eighteen (18) years of age to purchase Product from the Website and, by making a purchase, You are representing that You are of sufficient legal age to do so.

MEMBER ACCOUNT, PASSWORD AND SECURITY
If the purchase of certain Products (for example subscriptions) or the use of a feature or program requires that You open an account, You must complete the sign up process by providing us with current, complete and accurate information as prompted by the applicable registration form. You also will choose a password and a username. You are entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for all activities that occur under your account. You agree to notify VALUE immediately of any unauthorized use of your account or any other breach of security. VALUE will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, You could be held liable for losses incurred by VALUE or another party due to someone else using your account or password with your knowledge or if you fail to inform VALUE of any suspected or actual unauthorized use. You may not use anyone else’s account at any time without that individual’s consent.

PRICE, PAYMENT, AND ORDER
Price. The price of any Product is determined and set solely by VALUE. The prices published on the Website are subject to change at any time without notice and may not be available on other websites or at offline retailers. However, orders already submitted to us will not be affected by such changes. All prices are subject to the stated delivery charges, as well as any applicable taxes, duties, fees, or levies. The amount that You pay will be determined by the sales price set by VALUE, the discount coupon applied to Product (if any), the discount price through events (if any), shipping costs, and any applicable taxes. Users will be notified by VALUE if the advertised price of Product differs from the final purchase price of Product to be charged to the User. VALUE does not offer price matching on the Website and does not guarantee that it will honor lower prices presented at any time on the Website or by other websites or retailers. In addition, upon notification by VALUE of a difference in the advertised price and final purchase price, User shall receive an opportunity to confirm or cancel the purchase.

Payment. Users may purchase Products using the available payment methods accepted by VALUE, such as credit card, Apple Pay, PayPal, Google Pay. All information You provide at the time of your purchase must be valid, accurate and up to date.

Direct credit card payments are provided via our third-party payment service provider – VALUE does not process or store your credit card information. By submitting your credit card information, You are sending your basic, purchase, and financial information to our third-party payment service provider to process your payment and (if elected) store your information for future purchases. We encourage You to review our third-party payment service provider’s privacy policy and terms before use. Your credit card will be charged for a Product when the shipment process for your order has been initiated. VALUE will not be responsible for any failures of the third-party payment service provider to adequately protect your information. Please be advised that We may change the third-party payment provider from time to time. VALUE reserves the right to cancel any purchase or order, at any time, if we believe the transaction or payment to be suspicious or fraudulent. VALUE is not responsible if a purchase or order is completed without authorization from the card holder (this includes fraud or stolen credit/debit card information).

Third-party payment options may also be offered during the checkout process (e.g., PayPal, Google Pay, Apple Pay). These payment options are provided by third parties. We encourage You to review the third-party provider’s terms of use and privacy policy before use. VALUE will not be responsible for your relationship with the third-party provider.

Order. An order confirmation does not signify the acceptance of your order or constitute a confirmation of sale. VALUE may accept, decline, or place quantity or other limits on your order for any reason and at any time after receipt of your order. If VALUE rejects, limits, or otherwise modifies your order, We will notify You using the email address or other contact information you provide to us. If VALUE cancels an order or part of an order that we have already charged you for, We will refund you the full amount of payment. If Your order involves a promotion that offers bundled Products at a discount, including at no additional charge (e.g., “Buy one, get one free”), the entire bundle subject to the promotion (the “Promotion Bundle”) must be returned in order to receive a full refund. If You cancel or return part of the Promotion Bundle, the value of the discount You received will be deducted from Your refund, which could result in no refund being issued. If You return a Product obtained at no cost via a Promotion Bundle, no refund will be issued as to that Product (note: shipping is not charged on such Products, so there are no shipping charges to refund). All orders are subject to the terms and conditions of the promotion that is displayed on our website.

VALUE does not allow for order changes, additions, removal, or modification of any part of your order once it is placed. If a revision to the order is needed, you must cancel and repurchase. This includes changes to address, contact information, models, services, and third-party offerings. Order cancellations can be done through your online account or by contacting VALUE customer support.

If the order has already shipped, the order cannot be cancelled. Instead, you must return the Product(s) to the extent permitted under and subject to VALUE’s return policy. If a free service or promotional offering is not added to your cart at time of purchase, VALUE is under no obligation to add free services or promotional Products after the purchase has been completed. It is the responsibility of the consumer to read the terms and conditions to take advantage of the promotional offering. If a Product or model in your order becomes unavailable for any reason, including if we discontinue and/or stop supporting the Product or model after order confirmation, VALUE reserves the right to cancel the order and will notify You of the order cancellation and process a refund. VALUE will make every attempt at providing You with information about a comparable or similar Product or model, if any, that can be purchased by the customer. VALUE makes no guarantees that the same price can be offered on any such comparable or similar Product or model should You choose to purchase it.

SHIPPING
We will use commercially reasonable efforts to deliver products in a timely manner using the information that you provide with your order. Unless otherwise indicated at the time of your purchase, shipping and handling fees are included with your order. We reserve the right to increase, decrease, add, or eliminate shipping and handling fees from time to time. Shipping and handling fees will be disclosed at the time of purchase. Shipping dates and arrival times are only estimates and cannot be guaranteed.

Home Appliance orders and large appliances (“Major Appliances”) are currently delivered by our third-party delivery carrier. Due to their restrictions, some orders will not be accepted for specific zip codes and to serviceable delivery addresses. For Major Appliances, home delivery will be scheduled by a phone call. If installation and haul-away are included with the purchase, it may be scheduled for a second appointment. If the delivery carrier cannot successfully contact the recipient, delivery will be delayed or cancelled. All other deliveries will be made as curbside drop-off (“Curbside Deliveries”). VALUE provides Curbside Delivery only Monday-Friday. Carriers deliver to the curbside of a customer’s premises only. Lift-gates are available free of charge. You are responsible for placing the unit(s) inside your home. At this time, VALUE is unable to deliver to the following types of addresses: P.O. Boxes, addresses outside the United Arab Emirates, international addresses, Army Post Office (APO), Diplomatic Post Office (DPO) and Fleet Post Office (FPO). VALUE will not accept or will cancel an order if the street address is invalid or undeliverable.

Corrections to Shipping Address. If there are any errors or changes to a delivery address, You must cancel Your Order as soon as possible by telephone or through your VALUE Account.

Reschedule. If You need to reschedule your delivery date, you can do so through your VALUE account. We allow a one-time rescheduling of your order. If your order has already shipped, you may contact the third-party provider identified in a delivery confirmation email to coordinate. Our third-party providers will not hold an order for more than 30 days. Any attempt to reschedule a delivery more than thirty (30) days after original delivery date, will be returned back to VALUE and you will be issued a full refund.

Lost or Damaged Items. For loss claims, You must notify us within five (5) days of delivery if you believe all or part of your order is missing. For damage claims, you must notify us within five (5) days of delivery if You believe all or part of your order is damaged. VALUE may require picture proof of damage. VALUE will investigate any claims of lost or missing parts. This does not guarantee that a refund will be processed or that the missing Product will be replaced. If the delivery provider provides proof of delivery, no refund will be processed. Any order that has been refunded and subsequently delivered must be paid. VALUE reserves the right to process the return of Products in customer possession but not paid for. VALUE will re-charge customers’ original method of payment for any order refunded where all or part of the order is in the customer’s possession.

CURBSIDE DELIVERIES DO NOT REQUIRE YOUR SIGNATURE OR PRESENCE AT THE TIME OF DELIVERY. HOWEVER, IT IS STRONGLY RECOMMENDED THAT SOMEONE IS PRESENT TO RECEIVE SUCH PACKAGES TO ENSURE THAT THEY ARE RECEIVED SAFELY AND TO INSPECT THE PACKAGE WHEN IT IS DELIVERED. ALL SMALL PARCEL PRODUCTS ARE CURBSIDE DELIVERY ONLY AND NO SIGNATURE REQUIRED. OUR SMALL PARCEL CARRIER WILL NOT COMPLETE DELIVERY OF ANY PRODUCT INTO YOUR HOME. VALUE IS NOT RESPONSIBLE FOR ANY PACKAGES THAT ARE STOLEN FROM CONSUMER PROPERTY AFTER SUCCESSFUL DELIVERY BY OUR SMALL PARCEL CARRIER. MAJOR APPLIANCE AND ELECTRONICS DELIVERIES ARE SCHEDULED FOR DELIVERY IN ADVANCE TO SUIT YOUR CONVENIENCE. ALL RISK OF LOSS PASSES TO THE BUYER UPON DELIVERY FOR THE PRODUCT(S) TO THE THIRD-PARTY CARRIER.

Third-Party Services. All installations subject to the terms and conditions posted on the check-out page under “check installation & parts requirements” (the “Installation Terms”). There are several services that are not covered under our installation services. This includes, but is not limited to, hardwire installation, side venting, and propane conversion. We strongly recommend that you read the Installation Terms prior to making a purchase. Please note that our delivery & installation team will not install new Products onto existing Product, will not exceed two (2) flights of stairs, will not modify the home in any way, and cannot work with or touch exposed wires, rusted, or corroded shut-off valves, or copper valves. VALUE will not reimburse You for any out-of-pocket expenses if the site is not ready. For all “room of choice” orders, the delivery team will not unbox the unit, remove doors or modify home to complete delivery. All Products must fit through the designated delivery path in boxed condition. You are responsible for measuring all doors and entryways to ensure the Product will fit in boxed condition. If a paid service that You purchased was not provided, You will be entitled to a refund for that service.

RETURNS AND LIMITED WARRANTY
Return Windows.

For vacuums sold on the Website, the Return Window in which VALUE will accept returns for a refund is within thirty (30) days of Product delivery.

For all other Products sold on the Website (other than Outlet priced Products), the Return Window in which VALUE will accept returns for a refund is within fourteen (14) days of Product delivery. Provided the Product is not damaged, VALUE will accept returns outside of the Return Window within fifteen to thirty (15-30) days of Product delivery but will deduct from the refund a fifteen percent (15%) restocking fee. Refund will be provided once VALUE determines that the Product is not damaged.

The Return Window in which VALUE will accept returns for a refund for Outlet priced Products is within seven (7) days of Product delivery. If not damaged, VALUE will also accept returns of such Products after the Return Window within eight to thirty (8-30) days of product delivery but will deduct from the refund a fifteen percent (15%) restocking fee. Refund will be provided once VALUE determines that the Product is not damaged.

VALUE reserves the right to reject any Product returned to VALUE that is damaged or materially altered due to customer misuse.

Refunds will be processed for eligible returns to your original form of payment, usually within 2-3 weeks. Longer processing times may apply based on Your return of any Products received and during high demand periods.

Return Terms and Procedures. You may make a return request to us through email at orders@value-home.com, by calling our customer service number, or through your VALUE account. No Product may be returned to VALUE without a pre-approved RMA Number. Any Product returned to VALUE without a pre-approved RMA Number will be shipped back to you and no refund processed. Returns for Products after the applicable Return Window will not be accepted unless otherwise required by law, in which case Products may be returned as permitted by applicable law. Any Products sold as refurbished or “AS IS” are not eligible for return.

If visible damage is present at the time of delivery, refuse the damaged order or have the driver note “damaged box.” You must note any carton damage on the bill of lading (the form that you sign to verify delivery) when you sign for the order. In case of partial damaged delivery, please refuse only the portion that is damaged.

It is Your responsibility to promptly open and inspect Products at time of delivery and to initiate and complete any returns within the applicable Return Window. If the Return Window has expired, and you believe your Product to be damaged or defective, you must go through warranty support.
